Gator lending for wholesalers and investors

Gator lending for your earnest money deposit

Got a deal under contract and the earnest money due before your cash is free? We are the gator: we fund the deposit short-term on business-purpose deals and get repaid at closing through the settlement statement, for a flat fee agreed before anything is wired.

  • Flat fee per deal, in writing, repaid at closing
  • We read the contract and call title before we fund
  • Assignments, double closes, subject-to and seller-finance buys
  • Business-purpose only. No owner-occupant or consumer loans.

How it works

  1. Send the deal. Contract, EMD amount and due date, the title company, and your exit.
  2. We read the contract. The refund clause, the inspection period, who the escrow agent is and whether the deposit can be returned to us if you cancel in time.
  3. Written agreement. Amount, flat fee, repayment at closing, and what happens if the deal dies. You see it all before you sign.
  4. Title is told. We confirm with the escrow officer that the deposit is funded by us and payable back to us at closing, the same way an agent files commission instructions.
  5. We wire to title, never to you. After verifying the wire instructions by phone at a number we find ourselves.
  6. Repaid at closing. The deposit and the fee come off the settlement statement.

What we check before funding

CheckWhy it matters
Refund-to-designee clauseLets escrow return the deposit to the funder, not only to the named buyer
Inspection or option periodYour window to cancel and get the deposit back. After it closes, the deposit is usually at risk.
Seller releaseMany escrow officers release a deposit only with both parties' signatures, whatever the contract says. A pre-signed release on title's own form closes that gap.
The exitWho pays us back at closing: your end buyer, your private lender or your own funds
Wire instructionsVerified by phone every time. Wire fraud targets exactly this step.

When we say no

Restar Acquisitions funds deposits as a private business-purpose lender on specific investment deals. We are not a bank or a consumer lender, and nothing here is legal, tax or lending advice. Talk to a real estate attorney in your state about your contract.

Common questions

What do you charge?
A flat fee per deal, agreed in writing before anything is wired, and paid at closing out of the settlement statement with the deposit itself. We quote it after reading the contract, because the risk depends on the clause, the inspection window and the exit.
Is this a loan to me personally?
No. It is business-purpose funding tied to one investment property under contract. We do not fund owner-occupant purchases or anything for personal, family or household use.
What if the deal falls apart?
If you cancel inside the inspection period and the deposit comes back from escrow, it is returned to us under the written agreement. That is exactly why we read the refund clause and talk to title before we fund. The terms for a deal that dies are in the agreement before you sign it.
Do you fund in every state?
Not necessarily. Rules on private lending, licensing and interest limits vary by state, and we confirm the deal fits them before we quote. Some deals we will have to decline.
How fast can you wire?
We quote the same business day. Speed after that depends on how quickly title confirms the file and we verify their wire instructions by phone, a step we never skip.
Do I have to sell the deal to you?
No. We fund deposits on deals that close with other buyers too. If you want an offer from us as well, submit it separately.
